Patent Monetization
Patent monetization is generating revenue from patents and can be done in a variety of ways, including licensing, selling the patent outright, or suing infringers. Patent Litigation – We specialize in maximizing patent value through litigation. We are trial lawyers with deep experience in courts throughout the United States, including key jurisdictions for patent litigation such as the Western District of Texas, Eastern District of Texas, District of Delaware, the Northern District of California, and the International Trade Commission. We also work closely with foreign counsel to coordinate global litigation campaigns. This allows us to maximize value on a portfolio-wide basis.
Inter Partes Review – We have significant experience practicing before the United States Patent Trial and Appeal Board resulting in numerous validity decisions for patent owners at both the institution and final written decision phase.
Patent Licensing – We draft and negotiate IP licenses, with a focus on telecommunications, database technology, therapeutics, SaaS services, machine learning, medical devices, and data-driven businesses. We are also regularly involved in university licensing and complex spin-off transactions and have dealt with many leading U.S. universities, as well as a number of foreign institutions.
Patent Portfolio Assessment – We analyze patent portfolios to identify cornerstone patents, identify infringers, and forecast damages. Our analysis is critical to determining the value of a portfolio for eventual enforcement and for licensing or sale of a portfolio.

Commercial Litigation – Our team has litigated a wide variety of commercial disputes, including those involving trade secrets, false advertising, trademark infringement, and breach of contract (asset purchases, distribution agreements, loan securitizations, etc.), in federal and state courts, and in private arbitration.
Business Transactions – We structure and negotiate complex business deals such as partnering and collaboration agreements, joint ventures, and option deals across multiple industries, with a focus on therapeutics, SaaS services, machine learning, medical devices, and data-driven businesses. We also regularly provide IP, privacy (HIPPA, GDPR, CCPA, FERPA, etc.), and data security representation with respect to corporate transactions such as asset acquisitions, spin-outs, mergers, and venture capital investments.
Local Counsel – We coordinate with out-of-district national counsel to represent clients in federal courts in Texas and Washington, providing expertise as to local court practices. For these engagements we assist with local rules and practice, discovery strategy, pre-trial, and trial attendance.
